TERMS AND CONDITIONS

Annie’s Nannies is a trade name owned by Florence Nightingale Childcare Ltd.

Any reference in these terms and conditions to “Annie’s Nannies” or “the Agency” refer to the legal entity Florence Nightingale Childcare Ltd.  Any contract between parents or nannies is with Florence Nightingale Childcare Ltd.  Any reference to the Employer refers to the family who employs the nanny.  Any reference to the Employee refers to the nanny employed by the Employee.
Interviewing, acceptance and/or subsequent engagement of an Employee through Annie’s Nannies Nanny and Babysitting Agency constitutes acceptance of the terms and conditions.
The client must inform the Agency immediately after an applicant has been accepted.

If the Employer cancels the services of an Employee before the commencement of the work, half the applicable fee will be charged and the nanny will be paid 50% of the first week’s wages.
Annie’s Nannies Nanny and Babysitting Agency (“the Agency”) has used its best endeavours with regard to the nanny’s references, qualifications, training, experience and information disclosed by the nanny and/or referees to select a nanny suitable for your needs as advised by you.  If for any reason your nanny proves unsuitable or unsatisfactory for you, or the employment of the nanny is terminated due to the nanny becoming ill or terminating her/his employment, the agency will use its best endeavours to provide a suitable replacement nanny at no additional cost subject to the following conditions:

1. All fees owing to the agency have been paid.
2. The employment has not exceeded 4 weeks.  If the employment has exceeded 4 weeks and is less than 8 weeks, 50% of the agency fee shall be charged.
3. Any dissatisfaction, if appropriate, has been notified. (The agency accepts no responsibility for any grievance that is not advised to the agency within 2 working days of the grievance arising).

The agency fee is non-refundable and is paid for procuring the nanny.  Overdue accounts referred to a collection agency will incur additional costs, which are your responsibility.
The Agency acts as agent for you and is not an employer of nannies.  The Agency’s role is to procure suitable placements, bearing in mind the information and requirements supplied by you and the availability of suitable nannies.  Any contract of employment is between you as the Employer and the nanny as Employee or contractor.
The Agency accepts no liability or responsibility for any injury, loss mishap, accident or illness suffered by you or any other person as a result of the employment of the nanny and you agree to indemnify the Agency should any action be taken against the agency as a result of your employment of the nanny.  In the event that you, notwithstanding this clause, endeavour to issue proceedings and are successful against the Agency, then the quantum of damages shall be limited to TEN DOLLARS ($10.00).
